To the Worll. his Maties Justices of the Peace of and for
the City and Liberty of Westmr. in Quarter Sessions
Assembled.

Whereas by an Order of Genl. Quarter Sessions for the sd.
City and Liberty held by Adjournment the 30th. day of November
last It was referred to me Thomas Railton< no role > Esqr . one of his
Maties Justices of the Peace for the City and Liberty aforesaid
to take Bail for William O-Bryan who then Stood Commit [..]
to the Gate house being charged upon Oath for having
Comitted Several Disorders and particularly for Cursing
his Majesty< no role > for his Appearance at the then next Sessions
of the Peace to be held for this Liberty to Answer the Said
Offence, and to Convene the Persons before me who accused
and charged the Said O-Bryan< no role > (if they could be found) and
to bind them by Recognizance to Prosecute him at the
then next Sessions for the Said Offence, or otherwise to
discharge him If I Should think fitt.

Pursuant to which said recited Order of reference
I have made diligent Enquiry (but to no manner of Effect)
after the Accusers of the said O-Bryan< no role > and Particularly
Mr. Earl who was the Comitting Justice who acquainted
me that he did not know any of the Accusers which was
the Reason he did not bind them over to Prosecute and
desired that if none of them could be discovered the said
O-Bryan< no role > might be discharged And it Appearing to me
that the Said O-Bryan< no role > was in a very Poor & Starving
Condition and in no wise able to Procure any Sureties for
his Appearance or further good behaviour I did therefore
think fit to discharge him and did accordingly discharged
him from his Confinement on the 21st. of December [..]
All which I Certifye Under my hand this Seventh day
of January 1724.

Tho. Railton< no role >
