Year & Patlarly directs the very Weeks in which they shall be holden namely the first
Week after the feast of St. Nichl. in the first Week next after the Epiphany, in the
first Week next after the Clore of Easter & in the first Week next after the feast of
the Translation of St Nics Martyr: & mors often if need be These latter Words seem
as first sight to give the Magists. a Tower to hold their sess when they pleasd which
granting to be the Case, yet the stat Expressly directs that the sess shall be held in
those very Partar Weeks, yet for the sake of Convenience, empower the Insts. by
Adjournment or otiwise the hold their Sess ofter It seems necessary therefore to point
out a Case in which the above words seem to be the fins Subject (vizt) the Case of
K. and Polstend K. 20 G. 2d Burn 591. Where the Court held that the words in
2d. H 5 C. 4 and more after if need be were never considered as giving more than
one ough Sess in a Quarter, but only impowering Adjournt the county must
take not of adjournmt but ar not supposed to expect a two session till the usual
time And again in to West Torrington and North Nuresby J. 22 & 23. G.2.
A Quarter Sess Must be holden four times in the year as directed by Stature & it
may be adjourned from time to time & from place to place: but it it is one eropped it
cannot be resumed

As therefore the pursuant Epipp Sess are the next Genl. Quar Sess after the
Paupers Removal it is hoped the Court cannot possibly refuse hearing the present
Appeal, 6 moire partarly as they on the first day of the sess made and order for the
Hearung on Thursday which as before stated has been served on the respondrs

The Appls Sot is ready to make an Appt (it required) that he was not
aware of the Sesss being told ofter in Middx , then &. Counties, & that he
consequently conceived he appealed in time
