Maketh Oath that On Tuesday
last the Attended this Honorable Court and preferred an Indictment
against the said Dependant for Stealing two tea Spoons this
Deponents Property and Saith he fully meant and intended
to have appeared and Given Evidence against the said Defendant
this forenoon and Expected he should have been in time so to
have done but to his great Surprise finds the said Defendant
has been Discharged for want of Prosecution and this Deponent
saith he was Exceedingly crouded last night with a numerous
Company Consisting of upwards of Six hundred persons which
Caused him to Sit up late and when he went to bed was very
much fatigued which was the Sole Cause of his not Attending this
Honorable Court So early this morning as he Ought and intended
to have done and saith he did not absent himself from any
Wilful neglect or for any favor or affection towards the said Defendant but merely for the reason aforesaid
