the Defendant in this Prosecution maketh Oath and saith
that Mr. Serjeant sayor who is a Material Witness in this
Cause is absent from Town and will not return for several
Days and also that William Towler< no role >
Esquire another Material
Witness in this Cause is now at the City of Chichester
in
the County of Sussex
and could not possibly be suppened
to appear by this time And also that Charles Henderson< no role >
Esquire
another very Material Witness in this Cause is now
at Havre de Grase in the Province of Normandy but will
be in London in about Ten Days And also that another
very Material Witness in this Cause cannot be found at
so short a Notice And this Deponent is advised that
he cannot proceed to Trial with safety without their
Evidence, all of whom he will be able to procure by
the next Session therefore humbly begs that this Trial
may he respited untill the next Session
