prosecutor Maketh Oath and Saith that he did [..]
month of September last appear against the above
Named Deft for Felony or a Warrant Issued from
the Office of Mr. Justice Green in East Smithfield for
having Stoln Some Cotton the property of one Robert
Sinclar who this Deponent them served a a Servant
and this Deponent having then and there Appeared as
an Evidence agst. the said Thomas Ryan and proved
the said Cotton to be the Property of his said Master
he this Deponent was thereupon (as he has since
been informed and Verily) believes bound in a
Recognizance to prosecute the said Thomas Ryan
at the then next Session of the peace in and for the
County of Middlesex And this Deponent further Saith
that being Jgnorent What was to be done thereing
and thinking his said Master was to have prosecuted
the said Thomas Ryan for the offence aforesaid [..]
this Deponent did not know that he was [..]
appeared to prosecute the said Thomas Ryan
neither did he know that he was to Attend at the
Session House until a Spa. Was to have been
served up on this Deponent for the purpose of
Attending to give Evidence Agst. the said Thomas
Ryan And this Dept of wether saith that on or
about Saturday the sixteenth day of October
