The King on the Prosecution of John Mason< no role >
against
Edward Baker< no role > Assault

Edward Baker< no role > of Wells Street in the Parish of Saint
Mary le bone in the County of Middlesex Coachman
the abovenamed Dependant maketh Oath and saith
That he this Deponent having commenced an Action in
the Court of King's Bench against John made by him
the said named prosecutor for an Assault made by him
the said John Mason< no role > on this Deponent on the thirty
first Day of December Past in this Deponent's Dwelling House
in Wells Street aforesaid he the said John Mason< no role >
subsequent to the said Action having been brought
caused a Bill of Indictment (for an Assault charged
to have been made on the same thirty first Day of
December last by this Deponent on him the said John
Mason
< no role > in the Execution of his Office of one of the Constable
of the parish aforesaid) to be preferred against this
Deponent at the Sessions of the Peace for the said
County held in February last he the said John Mason< no role >
not having made any charge against this Deponent
at the Session in January last prior to the Commencement
of the said Action at this Deponent's Suit And this Deponent
farther saith that he hath caused Notice of Tryal in
the said Action to be given for the first Sitting within
next Trinity Term at Westminster Hall , and that he
this Deponent would have proceeded to Tryal of the said
Action in last Easter Term but this Deponent could not
safely proceed to Tryal thereof by Reason that he was
advised that Waters of Suffolk Street in the
Parish aforesaid Widow and Elizabeth Stanley< no role > Spinster
who lives with the said Mrs Waters as a Companion went
material Witnesses for this Deponent on such Tryal
and they the said Waters and Elizabeth Stanley< no role >
were then and stil are as this Deponent believes
absent from Town And this Deponent farther saith
that the said Waters and Elizabeth Stanley< no role >
being also material Witnesses for this Deponent on the
Tryal of the aforesaid Indictment without whose
