On the Prosecution of Mary Fidler< no role > Spinster for an
Assault with an Intent to Commit a Rape

Joseph Cooper< no role > Junior of Whetstone in the Parish of Fryan
Barnet in the County of Middlesex Tarner Maketh Oath and Saith that
the prosecutrix is Servant to this Deponents Father And this Deponent
further Saith that he this Deponent was Served with a Notice or Paper Writing
Purporting to be a Notice to Try the Defendants Traverse in this Prosecution
for the Prosecutrix not until Saturday the Sixth Instant at Four o Clock
in the afternoon which this Deponent conceives Necessary for the Defendant
to have done the Wednesday Proceeding the Session or Eight days notice
the Defendant having put in Bail last Session and Traversed to the present
Session to the Prosecutrix's bill of Indictment a Warrant from Joseph
Girdler
< no role > Esquire one of his [..] Majestys Justices of of the Peace for the
Said County of Middlesex was granted on the Twenty Sixth day of September
last past and Backed by I. Leroux Esquire one other of his
Majestys Justices of the Peace for the County of Hortford and the Defendand
Was taken thereon and gave Bail thereto as this Deponent hath been
Informed and verily believes And this Deponent further Saith
that he hath made Street Inquiry of the Attorney Sollicitor orand
Agent whether they had received for the Prosecutrix she being Ill and
not able to attend being under the Care of a Surgeon owing to the Ill Treatment
of the Defendant as the Prosecutrix Informed this Deponent or been served
in due time or otherwise howsoever (except as aforesaid) with any such
Notice or Paper Writing or any other person for them either at their
House Chambers office or last Place of a abode untill Saturday last
which this Deponent hath been Informed and verify believes is
Irregular for the reasons aforesaid as Appears by the Notice hereunto
annexed Signed by the Constable who left. same at the time when served

Adjournment in and for the County of
Middlesex at the Sessions House
Clerkenwell Green in the County aforesaid
