Hicks Hall Sessions

Between The King on the Prosecution of
Henry Whitmey< no role > Plaintist
and
Mary Newton< no role > Defendant

Henry whitmey< no role > of Kensington in the County of Middlesex
Gentleman the Prosecutior above named maketh Oath that on or about
the Thirty first day of July last this Deponant having been pushed
into a Ditch near Westminster Bridge and thereby became much
wetted and dirtied this Deponant went into a Public House in
Westminster in order to dry and clean himself upon which the Landlady
of the House offered this Deponant a Pair of Breeches to put on in
the Room of this Deponant's Dirty ones which Offer this Deponant
Accepted of and this Deponant took out of his Pockets Four Guineas
and an half in Gold Sixteen Shillings in Silver and some Copper
Coin and laid the same down upon a Table there and then Shifted
his Breeches which being done this Deponant saw this Deponants
said Money in the Defts Hands whereupon this Deponant caused
the Deft to be Apprehended and she was taken before Mr. Justice
Durden in Westminster who committed her to Tothilfields Bridewell
for further Examination and after a Second hearing Committed
her Absolutely for trial for the said Offence and this deponant and one
Robert< no role > WilliamBunting entered into Recognizance to Prosecute her on that
Occasion And this Deponant further says that he this Deponant
conceived that he was to Prosecute at the Westminster Sessions because
tha fact was committed in Westminster and because the Defendant
had been in the first instance committed to Tothilfields Bridewell
and accordingly this Deponant did prefer a Bill of Indictment
against her at the last Westminster Sessions which was foundtobe
aIssueTrue Bill and this Deponant intended to have prosecuted the same with
Effect but this Deponant to his Great Surprise has found that he ought to have
Prosecuted the sd. Defendant at the last Sessions held at Hicks Hall and that
having failed so to do she was then discharged and this Deponants Recognizance
has been or will be Exheated for want of a prosecution agreeable to its Condition
