On the Prosecution of Edward Hates< no role > for an Assault

An Indictmts. was prefer'd by Prosr. in last July Sess: and being found
a true Bill Attley was Committed for want of Sureties Soon afterwards
Prosr. died in St. Giles' s Workhouse in consequence of Catching a violent
Cold by getting wet, having been many years afflicted with a Concerted
Month which at last grew so bad as to prevent him from taking Sustenance
In the mean time Attley remaining in Prison Petitioned Mr. Paul Barbot< no role >
of Great St: Andrew Street St. Giles in the Fields Goldsmith to Bail him
which was done accordingly from a principle of humanity in order that the
Man (who is an industrious poor fellow) might be enabled to Provide for
himself and Family.)

As the Prosr. is dead there is an end of the Prosecution
but Mr. Barbots Recognizance remaining undischarged, You will
please to Move (stating the annexed Affidt. of Prosrs. being dead) that
proceeding may be stayed and the Recognizance Discharged
or Respited sine Die
