The King against John Attwood< no role > on the prosecution of
John Owen< no role > for a Misdemeanour

John Attwood< no role > late of Castle Street in the Parish of Saint of Saint Martin in the
Fields in the County of Middlesex but now of the Kings Bench Prison in the County
of Surry Yeoman the above named Defendant maketh Oath and Saith that he
being Indicted at the Session holden in April last in and for the said County
of Middlesex for a Misdemeanour at the Instance of the abovenamed Prosecutor
this Deponent did appear at the Sessions holden in Mas last of and for the said
County of Middlesex and pleaded to the said Indictment and Entred into recognizance
together with William Lane< no role > and William Robinson< no role > to try his Traverse upon the
said Indictment at the Sessions to be holden in and for the said County of Middlesex
in July last but before the said Sessions and after the entring into the said
Recognizances this Deponent was taken in Execution by the Sheriff of Middlesex
and removed by rent of Habeas Corpus to the Kings Bench Prison and could not
appear according to the Condition of the said recognizances this Deponent not
appearing the prosecutor by his Councel moved the Court to Estreat the several
Recognizance. of this Deponent and his said Bail into his Majesty's Court of
Exchequer and this Deponent further Saith that his not appearing to try his said
Traverse at the said Sessions did not proceed from and neglect of himself or his
said Bail but on account of his being a Charged in Execution in the Kings Bench
as aforesaid and which was Known at that time to the Prosecutor as this
Deponent Verily believes.
