Please to move that the Deft Robt Cornish< no role >

Recognizance may be Estreated for want of Notice of
Tryal, & that a fresh Warrt. may Issue agst. him, & that
he pay Costs, accordg to Affidt. herewith
Deft I beleive means to move to respite the
recognizance, on an Affidavit of two Material Witnesses
being in the Country, but this I am inclined to think
is not true, & is only done to save the Recognizances
on accot of their having forgot to give Notice of Tryal
If, the Court shood. grant Deft the favour he asks of
them, I hope it will be with Costs of this Motion; & that
the Deft will be bound to try his Traverse this Sessions
& not put Prosx. of untill the next
Deft says the two Witnesses that are out of the way
is a Man & a Maid Servt, Prosx. knows of no Man Servt

Evidence, Deft says the Maid Servt is gone to Salisbury
or
Rochester
; if so I conclude she is gone their to live for
good, & most likely got a place, their, so that she may [..]
never return for what we know, but as to her being in
the Country I can't beleive it true, as I have great
reason to beleive she is at Lambeth
with her Brother
in Law, or in some place in Town, as she has been
seen very lately at Defts
