the above named Defendant
Maketh Oath that last Sessions the prosecutor found a Bill of
Indictment against this Deponent for an Assault when this Deponent
put in Bail and fully intended to have tried his Traverse this Sessions
and for that purpose this Deponent has made the utmost enquiry in
his power after the said prosecutor to give him Notice thereof but has
not yet been able to find out his place of residence or where he is or
can be met with or where this Deponent could leave any Notice of Trial
for him save that about afortnight or three Weeksago
ago he called on this Deponent at his house upon which this Deponent
asked him where he lived or was to be met with or where this Deponent
could have any Notice for him when he absolutely refused to give this
Deponent any Information in respect thereto And this Deponent
further saith that he does not know where the said prosecutor dwells
or is to be met with or heard of, nor ever did
