Case

Margery< no role > Wife of Silvester Mc. Evey< no role > of the Parish
of St Mary White Chappel in the County of Middlesex Sales Mr
was Charged and taken in Custody by George Power< no role > a
Headborough of the Sd. Parish in July last upon have several
Warrants One on the Complaint of Ann Doude< no role > for an Assault
and the Other on the Complaint of the Said Headborough
George Power< no role > for the Peace, to which Said two Several was [..]
the Said Margeng was obliged to put in Baile for her appearand
thereto on the following Sessions no Bill of Indictment
being the Prefered or found upon the sd. two Several Charges aplycation was made the insuing
Session by the Sd. Defendant Margery unto Mr. White the
Crier who went into Court to have a Serck and Could find
no such recognizance on the Books but the Baile being [..]
the Sd. Deft. aplyed to Mr. Jefferson Deputy Clerk of the Peace [..]
his Office in Order to have the Said Recognizance discharged but
he refused so doing Aleaging that shee the said Deft. Margery
Mr. Evoy was Indicted upon a differant Charge against her at the
Suit of the Sd. Headborough George Power< no role > for an Assault

So that as there was no Indictment found upon the two former
Charges which ware pryer to the Charge upon which the Deft.
Stands Indicted Shee Prays. Youl plase to move the Court to have
the two former recognizances discharged this being Estreating
Sessions

The reason why Shee the Deft applyed to Mr. White was as
Shee waited all the Day and Particulerly when the Book was called
and not hearing her Name caled was to know the reason shee
was not caled as shee then could not come to Spake with Mr.
Jefferson Owing to the Croud

And the reason why Shee has not come in regularly
to take her Tryal upon the Sd. Indcitment is being poor
and had not Money to defray the Expence thereof and
knowing Mr. Power had Indicted her in the Heat of Passion
and not on account of any Violance by her Commited
on him and would when coole forgive the Said offence
