Reasons Submitted that Newgate should be Rebuilt [..] Judged necessary
at the Expence of the City without Aid of the County.

That Goal hath been twice Rebuilt and from Time to Time repaired by the City and tho' it hath been
a Goal near 600 years this is the first Attempt to charge the County.

On its being burnt down by the great Fire the City got a Grant from Parliament of one Shilling
P Chald. Duty on Coals for making Goals for Felons and other Malefactors and for other Public
Uses for a considerable Term.

The County maintain 3 Prisons exclusive of the Gatehouse which is maintained by the
Dean and Chapter of Westminster as Newgate is by London.

The true reason why the City have the Custody of the Middlesex Prisoners is they Enjoy a Grant
of the Shrievalty of Middlesex (holding the County Farm the Purpose) as well as of London , and
Elect the same Persons to Execute both those Offices-Newgate stands in and is the Prison of
London and the Sheriffs find it more Convenient, and least Expensive to keep but one Goal.

The City derive great advantage from the Shrievalty of Middlesex and raise great Sums by Fines for
not Serving the Office of Sheriff and it is a Maxim in Law. Quisentit Commodum sentire debet
et Onus-if they will take the Emolument they must bear the Burthen.

The City had seven Gates and have pulled down 6 of em with part of the City Wall , and sold the
Materials, and are letting the Ground on Fines and Ground Rents.

The City have large Revenues and the County have no Fund of any sort-Their County rate which is
already £1000. a year or upwards is taken out of the Poor rate.

The Petition of the Inhabitants near the Goal, Allede that there have been 1000 Prisoners P Ann.
committed to Newgate , two 3ds. of whom have been Middx Prisoners, and at the Morning of the Sessions
great Numbers have been Crowded into the Goal (but the dont say more have been Crowded in at any
one Time than two'd well Admit of)

The Cause of this Crowding (if so) is that they are removed from the Compters in London , the Gatehouse
Westminster New Prison, Clerkenwell and Tothill Fields Bridewells 6 days before the Goal Delivery
by an Order from their own Court in 1726. before which Time they were (as we Apprehend) removed
at the Sessions one by one or as Indicted and those not Indicted, were removed immediately to the
Court at the ending of the Sessions to be discharged.

N. The only reason for Building on a more extended Plan will be the demolishing the Gate the North end .
N. The City Petition has not alledged Inability to Rebuild; therefore can go upon matter of Right only.

The Managers for the County Pray that the Committee will be
Pleased to Call for.

The City's Charter of Confirmation, Granted by King Charles the 2d. which Contains all their former
Grants of the Shrievalty and Custody of the Gates their Jurisdiction in South wark as well as in
Middlesex .

Accots. Sheriffs Fines and the bye Laws for their Application-for which there is an Order.
The Produce of the Duty on Coals, and how much has been applied for Building and Repairing Goals.
The Produce of the Materials of the other Gates and the New Fines and Ground Rents.
An Account of other Public Stock not applicable to any Particular Purpose
What Orders have been found in the City's Journals for Rebuilding Repairing Altering or
Insuring the Gate; shewing the City absolute and Sole Owners.
