the Defendant in this Cause maketh Oath
That on Saturday the fifteenth day of October Instant he made
Stict and diligent Inquiry at Several Places after Susanna
Tilberry< no role >
in order to serve her with a Subporna to appear as a
Witness on the behalf of this Deponent on Trial of the said
Indictment at this Present Sessions and on such Inquiry thr's
Deponent was informed by John Price< no role >
of Titchfield Street
near Oxford Markett Taylor Brother in Law to the said
Susanna Tilberry< no role >
that on the Twenty Ninth day of August
last she set out for
Winchester
in the County of Southampton
to see her Friends and that he Expected her to be in London
about the Middle of October Instant But this Deponent
was informed by the said Price on Monday last that he had
had a Letter from the said Tilberry and that he was certain
and Positive that she would be in Town the latter End of
November next which information of the said Price this
Deponent verily beleives to be true And this Deponent
further saith that the said Tilberry is a material Witness
for him this Deponent on the Tryal of the said Cause and
without whose Testimony this Deponent as he is advised
cannot safely Proceed to the Tryal of the said Cause but
this Deponent Saith that he will use his atmost Endeavours
to have the said Susanna Tilberry< no role >
on the Tryal of the
said Cause at the next General Sessions of the Peace
to be Holden for this County And this Deponent further
Saith that he doth not know where his said Wife now
Lives or resides so as to serve her with Notice of Tryal
in this Cause
