Retain and Repopess as in their former Estate And the said James Sperling Henry Bankes< no role > H Richard Speed< no role > Thomas Light< no role > and
William Prowting their Exors Admors and assigns and all other Occupiers of the promisses thereout and from thence utterly to expell
put out and a move these presents or anything herein contained to the Contrary Notwithstanding provided Also and these presents are
upon this Condition that if the said James Sperling< no role > Henry Bankes< no role > Richard Speed< no role > Thomas Light< no role > and William Prowting< no role > their Admors [..]
or Assigns or any of them door shall at any time or times hereafter during the said Term convert the said premisses to any other Use than that of
the Charitable design of poor Lunatics then these presents and every thing herein contained shall cease determine and be utterly void
Anything herein contained to the Contrary thereof in any wise Notwithstanding Happeaw likewise in Evidence unto this Court that
before the Erecting the said Hospital divers to wittwentytwenty Nine houses were Situate upon the Land and premes in and by the said Indre
contained and demised And that in the Several Rates made by the Overseers of the poor for the Relief of the poor within the said Parish of St.
Luke [..] forthein and during the several yearsCurrentbetween the year of our Lord 1744 And the Date of the Indenture herein before
mentioned the said twenty Nine houses were valued and estimated at the Annual value of £196 by the year And that in the year of our
Lord 1745 the said 29 Houses being assessed in the Rate made in the said year for the Relief of the poor within the said Parish of St.
Luke safter the Rate and proportion of3s. in the pound Sterling did yet payno moreand yield no more to the said Overseers
[mark] in Satisfaction of the said Rate And towards the Relief of the Poor than £10.. 1.. 0 And that in the year of our Lord 1746 the said 29 Houses being
assessed in the Rate made by the Overseers of the poor of the said parish of St. Lukes in the said last mentd. year for the Relief of the poor
within the sd. parish after the sd Rate and proportion of 3s.in the pound Sterlingto the sdid yet pay and yield no more to the
[mark] said Overseers in Satisfaction of the said Rate And towards the Relief of the poor than £8-11:0 and that in the year of our Lord 1747 the
sd. 29 Houses being assessed in the Rate made in the said last mentd. year for the Relief of the poor within the said Parish of St. Lukes after the Rate &
proportion of 3s.. 3d.in the pound Sterling did yet pay and yield no more to the said Overseers in Satisfaction of the said Rate And
[mark] towards the Relief of the poor than 18..14:9And that in the year of our Lord 1748 the sd. 29 Houses being assessed in the Rate made in
the said last mentioned year for the Relief of the poor within the sd. Parish of St. Lukes after the Rate and proportion of 3s..in the pound Sterling
[mark] did yet pay and yield no more to the said Overseers in Satisfacon of the said Rate And towards the Relief of the poor than £1..1..0 [..] And
that in the year of our Lord 1749 the said 29 Houses being assessed in the Rate made by the Overseers of the poor of the said parish of St. Luke s
in the said last mentioned year for the Relief of the poor within the said parish of St. Lukes after the Rate and proportion of 3s.. in the
[mark] pound Sterling did yet pay and yield no more to the said Overseers in Satisfacon of the sd. Rate And towards the Relief of the poor than £6: 3: 0
And that in the year of our Lord 1750 the said 29 Houses being assessed in the Rate made by the Overseers of the poor of the said parish of St. Luke s
in the said last mentioned year for the Relief of the poor within the said parish of St. Luke safter the Rate and proportion of 2s:9 in the
[mark] pound Sterling did yet pay and yield no more to the said Overseers in Satisfacon of the sd. Rate And towards the Relief of the poor than £2..8..9
It appears Also in Obidence to this Court that the premisses so demised were Accordingly built and converted into the Hospital mentioned
in the said Article of the Rate in Question called St. Lukes Hospital for Lunatics for the affording a charitable and free sustentation and Cure
to poor and helpess Lunatics And that every Apartment and parcell of the said premisses so built and converted into Such Hospital as
aforesaid is laid out and applied either in Wards or Cells for the Lodging of such Lunatics as aforesaid Or in Offices necessary for their
Sustentation & Cure Or in Apartments necessary for persons who are hired from time to time to attend on Such Lunatics for their better
Sustentation & Cure And in no other Apartments or Buildings whatsoever And that the said Edifice was originally erected and Still is
Supported and very many poor and helpless Lunatics continually have been and Still are Sustained and taken Care of therein and the
Menial Servants attending upon Such Lunatics have been and Still are hired and paid And All other Expences Relating to & necessary
for the maintaining the said Hospital and Charity have been and Still are from time to time detrayed and born by the Free and Voluntary
Contribution of divers persons out of whom a Committee annually is appointed who meet Weekly to order the Admission and discharge of
patients the hiring and Relating Servants the paymt. of Bills And the Regulation of all other Matters Relative to the Maintenance and
upholding of this Charity And that none but such poor and helpless Lunatics and the persons necessarily attending upon them have any kind of
Dwelling or Occupation in the said Hospital And that One Joseph Mansfield< no role > the appellant is the principal person hired from year to year by the said
Committee of Contributors and Receiving certain Wages and living in the said Hospital for the purpose of attending on the said Lunatics And having
no other Abode Occupation or Establishment therein And that the said James Sperling< no role > Henry Bankes< no role > Richard Speed< no role > Thomas Light< no role > and William
prowting
< no role > or any of them their or any of their Exors Admors or Assigns have not nor ever had or can have any profit benefit or Advantage from the
said premisses or any part thereof Nor any possession or Occupation thereof otherwise than as aforesaid This Court upon Consideration of the
Circumstances above setforth is of Opinion That the said Tenement called St. LukesHospital ought to be assessed & Rated towards the Relief
of the poor by the said Rate And doth Accordingly dismiss the said Appeal and confirm the said Rate
