that the said Mary Usher< no role >
is a material Witness for these Deponents
and without her Testimony these Deponents cannot with safety proceed to
the Tryal of the said Indictment And all these Deponents further
severally say that they these Deponents from the information of the said
Mr. Minors and other Persons who have Within these few days seen the
said Mary Usher< no role >
as also from their own Knowledge believe that the said
Mary Usher< no role >
is utterly incapable to attend this Court to give Evidence on
their behalf during this Sessions at Hicks's Hall
aforesaid but are informed
and believe that she is in a fair way of Recovery and will be able to
attend for that purpose at the next Sessions And lastly these Deponents
Severally say that being deprived of the Testimony of the said Mary Usher< no role >
by the means aforesaid they have neither given Notice of Tryal to the
said prosecutor nor delivered or cause to be delivered any Briefs to Councell
for their Defence or Sued out a Venice in this Cause
