Oath and saith that he this Depont. together with Joseph Theakston< no role >
and John Sayor
(who is now in Flanders as this Depont. is informed and beleives) being Indicted at Hick's
Hall
by the said John Beale< no role >
and Richard Beale< no role >
for an Assault, this Depont. & the said
Joseph Theakston< no role >
pleaded thereto last Sessions And this Depont. Saith that the said
John Beale< no role >
and Richard Beale< no role >
stand also Indicted in this Court for an Assault on
the said John Sayer< no role >
to which Indictment they have pleaded and as this Deponent
is informed and beleives prayed a Respite of their Recognizances last Session
upon shewing such reasons as were Agreeable to this Worshipful Court and
obtained a Respite accordingly And this Deponent saith that he this Deponent
is by his Attorney advised that as there are cross Indictments and that as the said

is the Prosecutor of one and a Material Evidence in the other this
Depont. and the said Joseph Theakston< no role >
cannot safely go on to Tryal of the
