Samuell Stone< no role > of the parish of St: Martins in ye fields in the County of Middx
Mealman & James Brown< no role > the prosecuter named in the Indictmt. in this Clerk
on the Behalf of his Majesty Severally make Oath & Say And first this Dept.
Samuell Stone for himselfe Saith that he did abt. a Month age by the Orders. C
Direction of the other Deponent James Brown< no role > Enquire after one Thos: Pavey< no role >
herein undr. mentioned at the Place of his last aboade here in England wch. was
at Axbury in Hampshire & was then & there Informed by his Father That he the sd.
Thos. Pavy was gen on avey age to Newfound Land & was then out of England
and that he did not Etc pest him home hill abt. two or three Months which this Dept.
Samuell Stone doth Verily beleive to be true All which this Dept. did in forme ye
Sd. other Dept. James Brown< no role > & this Dept Samuell Stone further Saith that
he did Employ one Richard Darling< no role > of Christ Church to send this Dept. word
when the sd. Thos. Pavy came home And this Dept. did on the first of this Inst [..]
Decemr. receive a Letter by the Generall Pest from the sd. Richard Darling< no role > dated
the 27th. Novr. last wherein he Informed this Dept. that the Sd. Thos. Pavey was
not yet come [..] to England wth. this Dept. doth verily beleive to be true and
this Dept. James Brown< no role > for himself Saith that he Verily belevies that the sd.
Thos. Pavy is now out of England So that he cannot have him now to produce as
A Wittnesse for him on this Indictmt. & further Saith that he is a Materiall
Witnesse for him on this Indictmt. without whose testimony this Dept. cannot pceed
to try the Same And this Dept Saith he hath made the best Enquiry he can after the sd Thos.
pavy to find him out & produce him as a Witnesse for this Dept. on this Indictmt. but
cannot for the reason before setforth P due him this Sessions but hopes & beleives
he shall be able to P due him by the next Sessions by which time he is Informed
& beleives he will be here in England
