On an Indictment for an Assault upon

The Deft Thomas Patterson< no role > maketh oath that in Trinity Term last
was twelve Months an Indictment was found and returned into the Crown
office at the prosecucon of this Defendant against John Gross< no role > who is the
Prosecutor in this Cause and that on or about the fourth day of December
last the said Indictment in the Crown office came on to be tried before the
Right honble the Lord Cheif Justice Raymond When by Consent of
the said John Gross< no role > and of this Deponent and of Elizabeth Theedham< no role > Widow
this Deponent Sister all matters indifference between the said John
Gross< no role > and this Deponent and his said Sister were referred to the arbitrament
Judgment and final Determinacon of John Johnson< no role > Bryan Payne< no role >
and John Langham< no role > who were the three Foremen of the Jury sworn
and Impanelled to try the said Indictment in the Crown office and
this Dept further Saith that the said Jurymen took upon them
the Honble of the said Reference and examined the allegacons
and Witnesses both of the said John Gross< no role > and of this Dept. and his
said Sister and afterwards duly made and published their Award
in Writing bearing date on or about the Eighteenth day of January
last By which award the said Jurymen awarded ordered and
Adjudged That the said John Gross< no role > should on the one and thirtieth
day of the then Instant January at the Ship Tavern at Charing Cross
between the hours often and Eleven in the Foremen of the same day
pay or cause to be paid unto this Dept or his Attorney the sume of
Fifty pounds of lawfull Money of Great Britain And that therefore
the said John Gross< no role > and this Dept should at the same time and placed
mutually execute to each other General Releases of all Actions
and Demands untill the thirtieth day of November last and this
Dept further Saith that the sd. John Gross< no role > is now a Prisoner in the
Kings Bench Prison Charged in Execucon by the Court of Kings Bench
for Not complying with the Terms of the said award and for non p [..]
of the said fifty Pounds to this Dept pursuant to the said award and last this
Dept Saith that of the Indictment in this Court against this Dept
was found at the Sessions in October One thousand Seven hundred this
and One (as this Dept hath heard and beleives) and before that
making of the said Rule of Reference and award
