did personally Serve William Hesketh< no role > (who as this Deponent
is Informed & beleives is the Prosecutor in this Cause) with
a Copy of the Notice annexd On the twenty Sixth day of this Instant
August , And this Dept. further Saith that he this day
saw the said William Hesketh who did in this Deponents
presence declare that he would not appear to prosecute
the Defendant Martha Martin< no role > , And the sd. Deponent
John Izard< no role > Saith that he was in Company with the said
William Hesketh and the Dept John Johnson< no role > this Day and
the said Hesketh did at the Same time Declare he would
not appear to prosecute the said Martha Martin< no role > .
