to that he lived with Swain after his
being turn'd over upwards of Six Weeks upon wth. their Appeal was
allowed & the Order discharg'd
That by another Order Dated 5th. May last

who likewise Appealed agt. ye said
Order and a day Appointed by ye Cort. vide ye Order
Mr Kitson their Soll made Oath that he left a Copy of
ye sd. Appeal & Order of Court at ye House of Mr. Horne in the sd.
Parish of St. Mary le Bone
wth. a Person who told him Mr Horne
was Churchwarden of the said Parish, But
The Churchwardens & Overseers of St. Mary le Bone
not
Appearing pursuant to such Order & Notice the Court die Adjourned
ye said Appeal unto ye day following when ye sd. Churchwardens &
Overseers of St. Mary le Bone
then likewise not Appearing to Support ye sd
Order of Removal the Court did then Allow of the said Appeal &
discharge the said Order of Removall.put Order
Note Mr Horne tho' a Churchwarden of St. Mary le Bone
never Acts in the Parish affair
but was Noiated & Chose by the Lord of Oxford who always choses one Churchwarden
in that Parish as his Right but ye other Churchwardens who is chosen by the Inhabitants
is the person that always does ye Pish Business.
That upon Mr Horne's receiving the Notice of the said Appeal & Order aforesd. &
not Acting in ye Parish afaires Sent the same to Mr Lane and Overseer of ye sd. Parish
who being a Person of very great business & frequently out of Town & being in a
hurry when it came to him unluckily mistook the day & imediately went out of
Town & so the Appeal never came to the hands or knowledge of any other of the Offisey
there & so consequently cou'd not Appear
Therefore to Move the Court whether the Officers of St. Mary le Bone
shall be now Admitted to
a Hearing of the said Appeal
Notice of this Mocord has been given them
