the powers given by the said Acts It appeares likewise that On Middx
in last Easter week Scavengers were duely chosen and confirmed for the
whole Parish of St James Clerkenwell includeing the New as well as the
Old Parish for this present Yeare And that within twenty Dayes after
Such Eleccon & confirmacon the proper Officers & Inhabitants of the Said
Parish of St James Clerkenwell without the Concurrence of the Officers
chosen by the New parish made the Scavengers Rate now in Question
according to A pound Rate which Rate is Intitaled a Rate or Assessm [..]
made on the Inhabitants Possessors & Occupyers of Lands & houses in [..]
Parish of St James Clerkenwell in the County of Middx by A Pound
Rate of four peace in the pounds And after the rate of Eight Peace
every twenty pounds personall Estate toward Reimburseing John Feller< no role >
Thomas Lutwich< no role > Scavengers of the Said Parish the Severall Sumes of
Money by them disbursed to the Raker for cleanseing the Said parish
of the Dirt Ashes & Soile according to A late Act of Parliament in
that case made & pvided And Extends to and upon the Severall
Inhabitants within & throughout the Limitts of the Said Audient
parish of St James Clerkenwell Including as well the Inhabitants
of the Said present Parish of St Johns Clerkenwell as of the said
Present Parish of St James Clerkenwell Which Said Rate has been due [..]
allowed and confirmed by two of his Maties Justices of the Peace
within the Said Old Parish of St James Clerkenwell It likewise
appeares to this Court that the Petrs are Inhabitants resideing on th [..]
the Limitts of the Said New Parish of St Johns Clerkenwell And
that the Said Scavengers for the said Parish of St James Clerkenwell
have demanded & Endeavonred to collect the Severall Sumes
assessed by the Said Rate upon the Said petrs and other Inhabitants
within the Limitts of the Said New Parish of St John Clerkenwell
But the Said petrs Insisting that the Said Rate is nee wayes binding
on them or any of the Inhabitants of the said New Parish of St John
Clerkenwell and that the Same Soefarr as relates to charge the Inhitance
of the Said new parish of St John Clerkenwell ought to be Quashed &
discharges Whereupon this Court duely considering what hath been alledged
on both Sided Doth adjudge & Determine That the Said Rate is A good &
legall Rate and that the inhabitants aswell within the Said New Parish of
St John Clerkenwell as the Inhabitants within that part of the Said Old
Parish of St James Clerkenwell Which Still remaines unto th Said Old
Parish are chargeable & ought to be charged by & with the Said Rate &
ought to pay the Same as they are therein respectively Rated & Assessed
And that the Said Rate now in Question ought to be and the Same is accordingly
confirmed by this Court.
