For Perjury
In Novr. 1786 Mr Burlton employed Day an Atty to put in Special
Bail & Defend an Action he had been arrested upon wch was no Sooner
done than Day persuaded the Bail to take him into Custody on Pretence
of Surrendering him when they Extorted a Warrant of Atty to Confess
Judgment to Indemnify them & then let him go,
Mr Day next entered up Judgment Sued out Execon and put
the Sheriff into posson at Groton House
in Suffolk
where the Deft
hired and then took him into Custody on pretence of Surrendering him
& brot. him to London and locked him up at Gillatts the officers in
Rolls Buildings,
They then came to an Agreement with Mr Burlton that if
his Brother Edwd. wod. give them his Bond to Indemnify them &
for their Expences that they wod. withdraw the Execon this was agreed
to, the Bond was given but instead of withdrawg the Exon they
proceeded to Sell,
In Hilary Term the two Mr Burltons Moved the Court agt Day &
the Bail for breach of the agreemt. & upon that Occasion made an
Affidavit of such Agreement,
In Febry Sessons 1787 Day & one of the Bail Indicted Mr Burlton
for Perjury at the old Bailey
from whence they removed it to the
Kings Bench And at the Sittings after Trinity Term they Convicted Mr
Burlton by the Perjury for wch the present Indictmt. is preferred
agt Mr Day.
As this is an Offence of great Attrocity Please to Move for a
Warrant to apprehend M Day & that he may give forty Eight
hours Notice of Bail to the Prosecutor And that the Recognizance
may be taken in a Sum Sufft. to Secure his Appearance
to take his Trial
NB Mr Burlton has not yet received Sentence And next Term he is
advised the Judgment will be Arrested.
