Wednesday the Twelfth day of September in the Twenty Seventh Year aforesaid
before the said Justices of our said Lord the King last above named and others
their fellows justices aforesaid Cometh the said Robert Gilbrath under the Custody of
Paul Le Meseoier Esquire and Charles Higgins< no role > Esquire Sheriffs of the City of London aforesaid
into whose Custody in the Gaol of Newgate aforesaid for the Cause aforesaid he had been
before committed and being brought to the bar here in his proper person is committed
to the said Sheriffs Etc. and forthwith concerning the premises in the said Indictment
above specified and charged on him being asked in what manner he will be
acquitted thereof the said Robert Gilbrath< no role > says that he is not quilty thereof and
Concerning this for good and ill hesecets himself upon the Country and Thomas
Shelton Clerk of the Session of Gaol delivery of Newgate aforesaid who prosecutes for
our said Lord the King in this Behalf doth the like wherefore let the Jury thereupon
here immediately come before the said Justices of our said Lord the King last above
named and others their fellows Justices aforesaid and who have no
affinity to the said Robert Gilbrath< no role > to recognize upon their Oath whether the said
Robert Gilbrath< no role > be guilty of the felony aforesaid in the said Indictment
above Specified and Charged on him as not And the Jurors of the said Jury
by the said Sheriffs to this matter impannelled and returned to wit
Thomas Parker< no role > Richard Grace< no role > , William Cooper< no role > , Benjamin Good< no role > . William
Boddely William Wilson< no role > John Benham< no role > George Worthy< no role > Thomas Wood< no role >
John Stevens< no role > . George Weston< no role > and Henry Catmur< no role > being called come and
who being Choren tried and sworn to speak the truths of and concerning the
Premises aforesaid say upon their Oath that the said Robert Gilbrath< no role > is
guilty of the Felony aforesaid in the Indictment aforesaid above Specified
and charged on him in manner and form as in and by the said Indictment
it is supposed against him and that he at the time of committing the said
Felony or at any time since had no goods or Chattels Lands or Tenements
to the Knowledge of the said Jurors and upon this it is required by the said
Court hereof the said Robert Gilbrath< no role > if he hath or know of any thing to say
for himself why the Court here ought not to proceed to Judgment and
Execution thereof against him upon the said Verdict and the said Robert
Gilbrath saith nothing except as he had before sayed whereupon all and
Singular the premises being seen and fully [..] understood by the Court
here It is considered and adjudged by the Court here that the said Robert
Gilbrath be hanged by the neck untill he be dead and the said Robert
Gilbrath is forthwith committed Etc.
