Brief for Prose [..] .

Edwd. Dade the Prosr. is Country man lately from the West of England and
a Collector of Tolls under the Lessees of Hide Parke Turnpike as likewise his two Brothers all
young men of exceeding fair CharectorDeft. some few years since was a Sheriffs Officer for the
County of Herdford Discharged for bad behaviour and came to London there got into the reputeable
Employ of a Marsh Count Bayliff did not continue long in that Office before he began his usual
Tricks & soon got discharged from employ likewise and became a Prisoner in the Marsh [..] Prison
for Deft. where he remained a Considerable time. During his confinement his wife lived in the
Capacity of Chamber maid at one of the Inns in the Burrough & Ros [..] . Brother the Horsler as same
Place frequently Visited Deft. in Presen with his wife and these gave him [..] small sums of money as did
also his Brothers to support him till he could obtain his enlargement But never at no time which
or any other Place whatsoever either directly or indirectly ever had Concern Transaction Condition
on acquaintance whatever except as afsd. with the above Deft.Soon after Deft. obtained his
Liberty went to Cliffords Inn and made the annexed Affidavit to hold Deft. to Special Bail and Caused
him to be Arrested thereupon on his Duty at Islington Gate Confined him a few days on a Springing
House and there was frequently told by Deft he might easy be dicharged if he would only give
his promisary Note Payable to the above Deft for the Debt and Costs hear all he then required
Prosor. always told him he never had any concern whats with him & therefore would not be
imposed on by such bad People let the conseqce. happen as it mayProsor. before the return of the
Writ was taken to Prison & remained a Prisoner upwards of a week when two Friends became
Bail for him. Tho. Prosor. Bror. is in the same Ass. & Writ for 50 & upwards and a Toll
Collr. at Hide Park Gate Dept. has not attempted to Arrest him. Deft is Man of bad
Chars. has no Vissible way of living his abode about Charing Cross . Prosor. is very well informed
Deft. had Subborned two false Witnesses to give evidence in the Marsh Court that Prosn. had bought
Large quantity of Good from him Prosor. was therefore advised to sue out a Habeas Corpus &
remove the Cause into the Kings Bench & Sp. Bail put in thereon

Tis sejusted Deft. will move by Councel to quesh the Indt. as the matter is now sending in
the Court of Kings Bench and will also insinuate to the Court that it is a Malituous Prosor.
