over by David Wilmot< no role > Esqr . one of his Majesty's Justices of the Peace for the County of Middlesex to prosecute and Give Evidence at this present
General Session against the said Lewis oppenhein< no role > And this deponent
further saith that he sued out a Supoena duces Tecum out of the
Crown Office directed to the said Francis Warden< no role > Esqr . (one of the
Commissioners named and Authorized in and by the said Commission)
And the said William Priddle< no role > who are Material Witnesses for the
Prosecution and that without the Benefit of the Testimony of the said
Francis warden and William Priddle before the Grand Jury the
said Prosecutor cannot (as this Deponent is advised and verily believes) prefer
an Indictment against the said Lewis Oppenhein at this present
Session And this Deponent saith that he went to the said Francis
Warden's Chambers in the Temple in Order to serve him with a Copy
of the said Supoena and that upon inquiring for the said Mr: Warden
he was informed by a Servant that Mr. Warden was goine into
Sussex and would not be at House forofseveral Days and that
he also went to said Mr. Priddle's House in Order to serve him with a
Copy of the saidSupSubpoena and upon inguiring for said Mr.
Priddle he was informed by Mr. Priddles Clerk that his Master
was out of Town and had been so for some Time and that he
believed he was gone into Shropshire and could not tell when
he would Return and that he hopes and verily believes he shall
be able to procure the said Francis warden and William
Priddle to attend at the next Sessions
