in the Court of Exchequer to have the said two Notes delivered up and
for an Injunction to which Bill the said Defendant due time put
in his Answer and the said Cause in the Exchequer still and now
is depending and this Deponent Sixth that further to harrass and
perplex the said Defendant the prosecutor caused him and one

and another to be Indicted for a Conspiracy by obtaining
the said notes unduly and without any Consideration Whereas in
truth and in fact the said Defendant did at the request of the Prosecutor
give the Consideration aforesaid And the said Prosecutor was so well
satisfied therewith that at the time the said Notes were so give
by the said Prosecutor as aforesaid the said Prosecutor promised
the said Defendant to take up and pay the same when they became
due This Deponent therefore humbly hopes that the said Prosecutor
may be Compelled to make his Election before the said Defendant
shall take his trial on this Indictment either to waive such
prosecutor or dismiss his Bill in the Court of Exchequer
Sworn at Justice Hall in the
Old Bailey
