maketh Oath and saith that he this
Deponent was bound by Recognizance to Prosecute the said
William Lane< no role >
as this present Session for the City of London
for stealing a Silk
Handkerchief the Property of this Deponent and one Mr.
Capes was also bound by Recognizance to give Evidence
against the said William Lane< no role >
And this Deponent saith
that in Pursuance of such Recognizance he this Deponent
gave Instruction for an Indictment against the said
William Lane< no role >
for such Felony to the proper Clerk of
Indictments attending this Court and this Deponent [..]
and the said Mr Capes on Wednesday the sixth Day of July Instant were sworn to give Evidence before
the Grand Jury on such Indictment and the said Indictment,
was delivered to the Officer attending the Grand Jury and
this Deponent paid One Shilling thereon And this Deponent
saith that being totally ignorant that it was necessary for
this Deponent and the said Mr Capes to attend to give Evidence
before the said Grand Jury he this Deponent and the said Mr.
Capes omitted to give Evidence on such Indictment before the
said Grand Jury by means whereof no Indictment was
found against William Lane< no role >
And this Deponent saith that
being informed that is was necessary to attend the Court to
give Evidence against the said William Lane< no role >
