one half pare thereof wassold or pretended to have
been sold forby the saidSheriff of Surry for me more
than three hundred and eighty pounds or there abouts as Deponent believes and
this Deponent further Saith that in Michaelman Term one thousand seven
hundred and Sixty eight before such sale of the said Ship filed his Bill of
Complaint in the High Court of Chancery for relief in the premises and for a
fair account and Reckoning with the said Jonathan Cubb< no role > and which said
Cause came to issue and witnesses were examined on both [..] whereby it
will appear that the said Ship was really worth as the time of the sale
thereof Two thousand pounds [..] or there about he this Deponent having paid
laid out and corpended large sume of his own proper Money in the repairs of
the said Ship to the amount of Nine hundred pounds and upwards And
this Deponent saith that on or about the eight day of July one thousand seven
hundred and seventy one the said Cause came on to be heard before his Honor
he Master of the Rolls whereby his honor Decreed that an account should
be taken before a Master of that High Court between Deponent and said
Chubb and that the said Master should enquire whether the said Sale was
a pair sale and how otherwise. Old which by the said Proceedings of record
in the said High Court of Chancery more fully and at large well and may
appear and Deponent Saith that before such Duncree could be obtained
end after the pretended sale of the said ship as aforesaid this Deponent
John Cox< no role > on or about the tenth day of May one thousand seven hundred
and seventy being Conceiver that the said Jonathan Chubb< no role > was then
considerable indebted to this Deponent and being informed and having
great reason to believe that the said Chubb intended to bear the Kingdom
or by some other Contrivance to evade and delay payment thereof he this Deponent
was advised to cause the said Chubb to be arrested and held to Bail in the
Court of King Bench for thirteen hundred pounds for stones paid laid out
and expendd and other Matter as in the said affidavit Mentioned upon
which said action for want of proceeding thereon in due time he the said
Jonathan Chubb obtained and caused the same to be Nonprossed as Deponent
was informed and belives And this Deponent John Cox< no role > further saith that
having obtained the said Decre in the High Court of Chanury and upon
the special Testimony in the said Cause given as to the real value of the said
ship and after said Ship had been so sold in Execution as aforesaid and
being informed of the said Jonathan Chubb< no role > intention to have the Kingdom and
