David Rees< no role > of the Parish of Saint Andrew Holborn in the
County of Middlesex Gentleman Agent for the above named Deft
James Waller< no role > maketh Oath and Saith That the said Defendant
Attended the last Sessions at the Old Bailey in order to try his
Traverse upon the above Indictment and Subpenaed all his
Witnesses who also Attended for the purpose of giving their
Evidence on his Behalf And this Deponent Saith that
the Traverse Jury having been discharged before the said
Trial was intended to be called on the said Defendant
Recognizance was respited until the present Sessions of
Course And this Deponent further Saith That James
Preston
< no role > Esquire Clerk of the peace for the North Riding of
Yorkshire is a Material Witness on the part of the said
Defendant, and without whose Testimony the said Defendant
cannot safely proceed to Trial & is now in Yorkshire And [..]
Samuel Cox< no role > of Councel for the said Defendant Having informant
this Deponent and the said Defendant that the Worshipfull
the Recorder had sayed he would not try the said Indictment
while the Matter in Chancery between the Prosecutor and the
said Defendant was Depending the said Defendant declined
giving the said James Preston< no role > the Trouble of taking so long
a Journey.
