maketh oath
and saith that on Saturday the 4th. inst. Dept. being in the
Kitchin of his Mistress's House a little after ten of the
Clock in the Evening as Dept. believes he heardtwoa Notice

Blows given to some personin the Street on which
he openedopenStreet Door and went for ward towards the
Brick Wall standing before the House and immediatly
heard Blows struck very hard but on whom or who
struck the Blows or with what they were given this Dept.
knows not; that Dept. saw three persons in Man
Apparel; that the person who Dept. believes was
struck ran away, and one of the other men steping
up to the other, said for God's sake do not strike him,
meaning as Dept. believes, the man who ran away
with a stick, for we are all Brors. and furr. Dept. knows
not.

and the deced both Depts. Brors.
and this
Dept. having been on Saturday the 4th. inst. to the Heath
a small distance from Mrs. Arnolds House to fetch a
Tree by [..] which had been lately cut down to the deced & House
and thedecedsaid Walter not being able to move the [..]
being exasperated struckthe decedWalter upon one of his Anns
with the Handle of a Mattock wch he had then in his hand
and brought thedecedsd. Walter to the Ground, that they
were both much intoxicated with Liquor: that after
the deced had given Walter sevl Blows, Walter took the
Mattock from the deced and struck the deced once
with it upon one of his Shoulders which brot. the deced
to the ground, that the deced then run after Walter & took
the Mattock again from him & struck him again with it
sevl. times; that Dept. pressed the deced not to strike Walter
any more, but the deced notbeing

with it again: that the deced persisted in beating sd. Walter both
with his Feit and the Mattock and knocked Walter down, [..]
