Deponent John Barry< no role >
for himself saith that Mr. Dionysias
Callaghan< no role >
of Sweetings Alley
near the Royal Exchange
and who gave Evidence before the Grand Jury upon the finding
of this Indictment is a Meterial Witness for this Deponent
in this Prosecution and without the Benefit of whose Testimony
this Deponent cannot as he is advised and verily believes
safely proceed to the Trial thereof And this Deponent

saith that he is the Son in Law
of the said
Dionysias Callaghan< no role >
and that he the said Dionysias
Callaghan was last Night seised with the Gout and a
Fever and is now confined thereby to his Bed and is so ill
that he cannot at this Time possibly attend this honourable
Court on the Trial of this Indictment without the
almost Danger of his Life
