London Merchant
the Defendant in
this Cause maketh Oath and Saith that the Bill of Indictment now depending
against him being found by the Grand Jury in last February Sessions He this
Deponent did voluntarily appear and plead there to the same Sessions without
being taken up or apprehended by any Warrant for that purpose and Entred
into a Recognizance with Sufficient Sureties to try the same at this present
Sessions holden for the City of London
And this Deponent saith that in pursuance
thereof he did some Short time afterward, write and send a Letter to Mr.
Benedictus Andrias< no role >
Merchant
who now (and for a longtime before the said
Indictment was preferred against this Deponent) resides at Amsterdam
in
Holland
in Order to have the Benefit of his Testimony on the Tryall of this
Indictment at this present Session But this Deponent saith that he hath since
recieved a Letter from the said Benedictus Andrias< no role >
wherein he informs this
Deponent that he is in an ill State of Health and could not possibly be in England
time Enough to be a witness for this Deponent at this present Session But
that he would come over to England as soon as Possible and give Evidence
for this Deponent at the Tryal of the said Indictment And this Deponent
Saith that he is also informed and verily believes that the said Benedictus
Andrias will be in England at or before the next Ensuing Session to give
Evidence for this Deponent at the said Tryal And Lastly this Deponent
saith that the said Benedictus Andrias< no role >
is a Material Witness for this
Deponent at the Tryal of the said Indictment And that he this Deponent is
advised and verily believes that he cannot safely proceed to Tryal of the
said Indictment without the Testimony of the said Benedictus Andrias< no role >
.
