John Drinkwater< no role > the Prosecutor in this Cause maketh Oath
that he this Deponts. had several Subpena's made out to
Serve upon his Witnessess but upon Application for [..] Service
thereof found that Mr. John Chambers< no role > of Lincolns Inn
Gent who was to have provd. the record Thomas Smith< no role > Deputy
Keeper of Woodstreet Compter, and John Clerk< no role > a Martial Court
Officer who are allJustices Court officersMaterial Witnessess
for the prosecutor in this Cause are gone into the Country which
prevented this Depont. from Serving them with Subpenas
And this Depont. says that he Cannot trye this Cause so as to
Convict the Defts. without their TestimonysAnd this Depont
further says that to [..] to Mr. Bennen [..]
Serve in Order to Appear and plead for the [..] in this
Cause, who says that he Cannot Attend the Court this Sessions

And this Depont. further says that the Defts. on Motion of Court put this Cause
of lost Sessions on pretence of one of them being List
