Patrick Barnewall< no role > Esqr . the Deft. in this Indictmt. maketh
Oath That he was Arrested upon a Warrt. grounded on this Indictmt. abt. the nineteenth
day of Aprill last (before which time this Dept. knew nothing of the sd. Indictmt.)
And this Dept. abt. 3 or 4 days afterwards put in bail before my
Lord Cheife Justice Raymond And the Bail now proposed by the Dept.
were taken and accepted as bail for him this Dept. thereupon And
this Dept. Saith he did soon afterwards Cause the Court of Kings
Bench to be moved in order to remove the sd. Indictmt. by [..]
Certiorari into that Court, this Dept. then apprehending he could
doe the same And this Dept. obtained a Rule thereupon And
Caused a Certiorari to be made out by Mr. Pember his Clerk
in Court pursuant thereto And Bail was [..] put in upon the
sd. Writt before Mr. Justice Powys But the said Certiorari [..]
being directed to the Justices of the Peace Etc in Middx (this
Dept. not then knowing where the sd. Indictmt. was laid) & this
Dept. finding the Mistake and that it was in London This
Dept. thereupon applyed himselfe to Mr. Tanner by this Depts:
Sollr. [..] to know what was to be done therein And saith he
didagainby advice of his Councel Cause the sd. Court to be moved
in last Tenne again for a certiorari into London, but the same not being
granted this Dept. is now ready to put in bail and to Traverse
the sd. Indictmt. & try it in this Honble Cort And saith he never
intended to delay the Prosecutor but is willing to try the sd. Indictmt.
as this Honble Cort Shall direct and hopes it will appear to be
a very malitives prosecution and without any Foundation notsoever
