maketh Oath That this Depts. said Mar. went to the Bath
about Eight Weeks since by the direccon of his Physitian
for the Recovers of his health being then very much
Indisposed as this Deponent beleives And this Deponent
further saith That his said Mar. hath Attended several
times at the old Bayly from one Sessions to another
in order to Examined as a Witness on the behalf of the
said Defendt. to the Indictmt. brought against the said
Defendt. at the prosecution of William Churchy< no role > the Dept.
haveing heard his said Mar. tall several times about
what he could Swear on behalf of the said Burt at
the Tryall of the said Indictmt. And this Dept. further
saith That he this Deponent Reced ye Letter hereunto
annexed by last Mondays Post from histhesaid Master
the Contents whereof this Dept. verily beleives to be free and
this Dept. further saith That he this Dept. did on
Yesterday the ninth Instant leave a Notice in Writing
with Mr. Churchy's Servt. Maid at the said Mr. Churchy's
house for the said Mr. Churchy prosecutor of the said
Indcimt. against the said Thomas Burt< no role > purporting yt.
the said Deft. intended to more the Court the Morrow
Morning or as soon after as Councell could be heard that
the Tryall of the Indictmt. for Perjury might be putt off
till the next Sessions by Reason of the absence and Indesposition
of Mr. Langley Hill who is a materiall Witness for the said Deft.
or to that Effect.
