Wee finde that on the day yeare & place in the
Indictmt. menconed in the open Streete there The
said Xpofer Abell< no role > & John Denny< no role > in the Indictmt.
named agreed together to take & snatch away the
Hatt from of the head of the said Thomas Wigg
in the Indictmt. menconed That thereupon the said
Xpofer Abell by the said agreemt. came to the said
Thomas Wigg & tooke & snatched his said hatt
from of his Head & rune away therewth. The
said John Denny being then Prsent & abetting
him the said Xpofer Abell to doe the fact aforesaid
And the said Thomas Wigg pursueing the said
Xpofer Abell for soe doeing The said Thomas
Wigg was imediatly hindred & opposed therein
By the said John Denny The said Thomas Wigg
being nott putt in any feare of his life no
apprehensive of any lesse untill after his hatt
was taken away as aforesaid But whether This
bee a felonious stealing wth. in the statute of the
9th of Elizabeth ca: 4th: or not two are ignorant
And if itt shall be adindged a felonious stealing
wth. in that statute wee finde the said Xpofer
Abell & John Denny Guilty And that they had noe
goods Etc But if itt shall bee adindged not to be a
felonious stealing wth. in the same statute Then
wee finde them not Guilty And that they did not
fly for the same
