That the Trial on Such Indictment could not come on that day and Consequantly
Ordered his said Servant and Witness to go home And this Deponent further Saith
That on the next or following day in the said Session he this Deponent his Said
Servant James Carly and Witness's did again duly attend at the Said Session
House and After Examining and reading over the list of Names Usually set
up for Inspection as aforesaid and finding tha the name of George Knox< no role > was not
thereon he this Deponent thought Proper to make a More Particular Inquiry
and when to his great Surprise he was informed by One of the Officers of this
Honourable Court that the said Defendant George Knox< no role > had been Discharged
by the Court by the Name of George Kings whereupon this Deponent is
Informed that having been bound in Recognizance by the Magistrate who had
Committed the said George Knox< no role > as aforesaid the same became them
forfeited through such Mistake in the aforesaid list of Prisoners Names And
the Ignorance of him this Deponent which happened as aforesaid and this
Deponent is Informed that Unless relieved by this Honourable Court Such
recognizance are liable to be Estrated into His Majestys Court of Exchequer
from whence, this Deponent Apprehends Process May Issue for Levying the
ammount of the Penalty Specified or Mentioned in Such Recognizance on
the Goods and Chattles of this Deponent, or that he person of this
Deponent is liable to be taken and Imprisoned for the same Therefore
this Deponent Humbly Prays and Hopes from the Circumstances aforesaid
That his Honourable Court may please to Grant their order that his
Said Recognizance may be respited and this Deponent freed from the
same or Such Other favourable Order as this Honourable Court May
Please to Make on his behalfAnd this Deponent James Carly for
himself Saith, that he hath read ever the foregoing Part of this Affidavit
and the Matters therein Contained and set forth, so far as Relates to him
this Deponent, Are true,

Sworn in Court at Justices Hall in the Old Bailey the 3d Day of
June 1789.}

on his part respecting the above Prosecution did not happen from any Motion
view of Interest or friendship or any Other Cause Whatever then as above
