Henry Filts< no role > of Saint Clements Church Yard in the County of Middlesex
Shoemaker and Edward Atkinson< no role > of the same place shoemaker make
Oath and say that on or about the Thirty first day of December last they these
Deponents were bound in Recognizance in the penal sum of Forty pounds
each before Sir John Fielding< no role > Knight one of his Majesty's Justices of the
peace for the said County of Middlesex upon condition that he this
Deponent Henry Filts< no role > [..] should prosecute and Edward Atkinson< no role > give
Evidence against Catherine Cole at the then next session for Feloniously
Stealing a pair of shoes the property of the said Henry Filts< no role > and these
Deponents say that they both attended at Hicks Hall and preferred a Bill
of Indictment against the said Catherine Cole for the said Felony and gave
Evidence thereon before the Grand Jury and these Deponents say that they
both attended at the Sessions House in the old Bailey on Wednesday the first
day of the Sessions from about Nine o' Clock in the Morning untill past
Ten at Night in order to give their Evidence against the said prisoner
and these Deponents say they both attended the next Morning Thursday
at about half an Hour after Nine o' Clock when they were informed the
said prisoner was Discharged and these Deponents have since been informed
that their said Recognizance was by this Honourable Court ordered to be
Estreated and these Deponents further say that they did not Neglect to Attend
through any favour or Affection or for any Reward or the hope or promise
thereof but that it was entirely occasioned by these Deponents having been
informed that a Mr. Griffiths was to have been Tried the first thing in the
Morning therefore these Deponents thought if they attended at half an hour
after Nine in the Morning it would be time enough but the Tryal of the
said Mr. Griffith being put off the said Catherine Cole's Tryal came on the
first and she was Discharged the Instant before these Deponents went into
Court
