did go to the said Sessions house on the Saturday Morning
following and this Deponent got into Court and remained there
until he heard the Prosecutor Joseph Ball< no role > and himself called upon
which he this Deponent went out of Court to search after the
Prosecutor whom after searching for about half an Hour he found
Drinking in a publick House in the Old Bailey and this Deponent
immediately went back with the prosecutor to the Sessions House
and on going into Court saw the prisoners go from the Bar they
having been Acquitted by the Jury for want of the said Prosecutor
and this Deponents Appearing to give their Evidence against them
and this Deponents and the said Prosecutors Recognizance was
Ordered to be Estreated for such their Neglect And this Deponent saith
that such his Neglect was not with intention that the said prisoners
might Escape Justice or through favour or Affection or for any
Reward or the hope or promise thereof but that it was entirely
occasioned by the said Prosecutor whom this Deponent went in se [..]
after as aforesaid And this Deponent is very poor and has got a Wife
and large Family therefore he humbly Prays that this Honourable
Court will be Pleased to Order his said Recognizance to be Discharged
