on an Indictment for Stealing a quantity of Tea and other Goods to the Value
of five shillings and four pence. Waketh Oath and Saith That he this Deponent
was charged with the said Felony by the said Prosecutor on the 14th. day of October
last before Saunders Welch< no role >

And by him Committed to his Majesties Prison of the Gate house
Westminster
for the said Offened And at which time and at other times afterwards the said Prosecutor
with one Peter Smith< no role >
a Constable
and Brother in Law
to the said Prosecutor and
their Abbetters did take from the Person of this Deponent and out of his Box two Silver
Watches a Silver Chain a Lottery Ticket and shares of Lottery Tickets and Moneys
amounting in the whole to the Value of Fifty Pounds and Upwards beside Several
Letters and Papers: That the said Prosecutor at the time of the Commitment of this
Deponent did Owe to him Eleven Pounds for and Years Servilude and Did also Obtain
from him during his Imprisonment in the Gale house an Order in Writing to and
Mr. Sharpe and Office Keeper in Holborn whereby he received the sum of Thirteen pound
as this Deponent is Informed and verily believes to be true and which said Several
Sums of Money Goods and Effects were then the real Property of this Deponent [..]

This Deponent Smith that from the time of his first Commitment he did
receive on his Several Examinations by Order of the said Justice twenty eight Shillings
or their Abouts and from the said Prosecutor four Guineas and from the said Constable
two Guineas towards his Support and maintenance during his long Imprisonments
That this Deponent did duly Authorize Mr. John Ridgway< no role >
his Attorney
to ask
Demand receive and take of and from the said Prosecutor and the said Mr. Smith the said
Several Sums of Money & before mentioned and every Part thereof and which were refund
to be Delivered up to him as this Deponent is Informed and verily believes to be True
This Deponent Smith that for the want of the said Money Goods and Papers he
hath been deprived and presented of Subpenaing the Revd. Mr. Sayer of Bristol
and this
Deponents Broker and others who are material Evidences on his behalf on the said Indictments and
without whose Testimonies and also for the want of having in his Possession his
Property aforesaid this Deponent cannot safely go on his Trial.
