The King against Mary< no role > the Wife of George Burton< no role > (on the
Prosecution of Samuel Cocke< no role > ) for Felony in Stealing out of his shop
a Piece of Muslin of the Value of Four Shillings his Property

Samuel Cooke< no role > of Oxford Road in the Parish of Saint Mary Le
Bone otherwise Mary bone in the County of Middlesex Linnen Draper
the abovenamed Prosecutor (and Humphry Negus< no role > of Cheapside
London Linnen Draper Severally Make Oath (as follows) and
first this Deponent Samuel Cooke< no role > for himself saith that he Did in
Tuesday the seventeenth Day of this Instant September preferr a Bill
of Indictment and Give Evidence thereon to the Grand Jury at Hick's Hall
against the said Mary Burton< no role > for the abovementioned Felony And
this Deponent Samuel Cooke< no role > further Saith that on Wednesday the
Eighteenth Day of this Instant September he Went to Hicks's Hall
and Applied to the Clerk of the Peace or his Deputy thereto
know whether such Indictment was found, and paid him his Fee
for such Search, which said Deputy or Clerk informed this
Deponent that the said Indictment was returned Ignorance by the
Grand Jury, and that this Deponent Need not Trouble himself any
further in this Affair, and which Answer this Deponent verily
believed to be True But this Deponent saith that to his Great
Surprize on Saturday last he was Informed by a Servant of One
Mr. Powell a Pawnbroker and this Deponents Neighbour) who
had Attended this Honourable Court that Day upon Same other
Business that he Heard this Deponent Name Called in Court to Came
forth and Prosecute the said Mary Burton< no role > according to his Recognizance
and that an this Deponent not Appearing thereto the said Mary Burton< no role > was
Discharged by Proclamation And this Deponent on his Oath Positively
Saith that his Man attendance to Prosecute the said Mary Burton< no role > was
Intirely Owing to the Information Given him by the said Deputy or Clerk at
Hicks's Hall that the said Bill of (Indictment was found [..] as
aforesaid and was for any other Cause or reason whatsoever, And the other
Deponent Humphry Reigns for himself saith that he this Deponent Did
on Saturday last Go with the other Deponent Samuel Cooke< no role > to Hicks's
Hall aforesaid to Enquire whether the said Bill was found 1749 [..]
returned [..] aums when he said Clerk or Deputy Clerk of the Peace
Informed the said Samuel Cooke< no role > in the Presence and hearing of this Deponent
that the said Bill of Indictment against the said Mary Burton< no role > for the
aforesaid Felony was not found True by the Grand Jury there but was
returned [..] mus as aforesaid
