last, of which he languish'd till the 25th, and then died </rs>

It appear'd upon the Trial, That some words happening between the Prisoner and the Deceas'd,(being both Pensioners of Chelsea College) the Deceas'd went and fetch'd a Sword under his Coat, and threatned the Prisoner if he did not go with him. A Witness depos'd, That he saw them fight, and would have parted them, but could not; but in a little time they put up their Swords, and went away both together into the Prisoner's House, where the Deceas'd was dress'd and drank, and smoak'd a Pipe, and was with much Difficulty perswaded to go to his Chamber; and when he was there, would not go to Bed all Night. Before he died he forgave the Prisoner, and said that it was all Heat of Passion; and the Jury considering the Circumstances of the Matter, found him <rs id="t17141209-41-verdict228" type="verdictDescription"> <interp inst="t17141209-41-verdict228" type="verdictCategory" value="guilty"></interp>
