<p n="360">INDICTMENT, for not repairing a certain public Bridge<lb></lb>
caled <rs type="placeName" id="LMSMPS50815_geo195">Glusburne Bridge</rs>

.-The Defendants pleaded, That<lb></lb>
there was an ancient Foot Bridge over Glusburne Brook,<lb></lb>
which, on the 1st December 1744, the Inhabitants of <rs type="placeName" id="LMSMPS50815_geo196">Glusburne</rs>

took down; and in lieu and Stead thereof, and in the Place<lb></lb>
where the Foot Bridge stood, they erected <rs type="placeName" id="LMSMPS50815_geo197">the Bridge</rs>

in question,<lb></lb>
for Horses, Carriages, etc.-That the Inhabitants of Glusburne<lb></lb>
had immemorially used to repair the said Foot Bridge, and from<lb></lb>
the Time of erecting the new Bridge had repaired, and ought<lb></lb>
to repair the same;-and traversed the Right of the Inhabitants<lb></lb>
of the Riding to repair; on which Traverse Issue was joined.</p>

Utility.</p>
<p n="362">On the Trial at last York Assises, before Mr. Justice Gould,<lb></lb>
the following Case was stated.</p>
<p n="363">That there was an antient Foot Bridge over Glusburne Brook,<lb></lb>
and a Ford for Horses, and another for Carriages; and that<lb></lb>
the Inhabitants of Glusburne always repaired the said Bridge.</p>
<p n="364">That, in 1743, on an application to the Quarter Sessions or<lb></lb>
the West Riding of <rs type="placeName" id="LMSMPS50815_geo198">Yorkshire</rs>

by the Inhabitants of <rs type="placeName" id="LMSMPS50815_geo199">Glusburne</rs>

it was ordered by the Court, the 11th January 1743, that the<lb></lb>
Treasurer should advance 10 l. out of County Stock, as a<lb></lb>
Gratuity, to enable the said inhabitants to build a <rs type="placeName" id="LMSMPS50815_geo200">new Bridge</rs>

over Glusburne Ford.</p>
<p n="365">the. 10th July 1744 the said Order was renewed, with Proviso, that<lb></lb>
nothing therein should extend to charge the Inhabitants of the<lb></lb>
Riding, with the Repairs of the said Bridge; which Sum was<lb></lb>
accordingly paid.</p>
<p n="366">That the Inhabitants of Glusburne built a Bridge for Carts,<lb></lb>
Carriages, and Horses and Foot Passengers; and pulled down the<lb></lb>
antient Foot Bridge, and sold the Material-That the new Bridge<lb></lb>
was of public Utility, and used constantly till 1767, when it was<lb></lb>
carried away by a Flood.</p>
