Order to oblige Suitors

Whereas the Tryals of Traverses upon Indictments

depending in this Court have been much delayed by reason

that the Defendants and also the Prosecutors of Such

Indictments do not appear at the first Sitting of the Court

in order to have such Indictments tryed for want of

whose Appearance the Court cannot proceed to the tryal

of the Said indictments, which is a great hindrance to the

dispatching the Business of the Sessions, For the

Prevention of Such Inconveniences for the future

It is Ordered that if the Defendants do not appear

at the first sitting of the Court to try their Traverses

upon such Indictments that their Recognizances Shall

be estreated and that the Same Shall not be respited

without payment of Costs to the Prosecutor, and in Case

the Prosecutors Shall not appear at the first sitting of

the Court in order to give Evidence upon such Indictments,

that then the Defendants upon proving Notice of Tryal
