Wednesday the Sixteenth Day of the said Month this Deponent Condicted<lb></lb>
the said Defendant before a Magistrate who Committed him to prison to<lb></lb>
answer for the said Offence and Bound this Deponent over to Give Evidence<lb></lb>
against the said Defendant at the next Sessions of the Peace. And<lb></lb>
this Deponent Saith That the Sessions being on the said Wednesday<lb></lb>
holden at Justice Hall in the Old Bailey he this Dponent Did<lb></lb>
Attend with the Prosecutor and Give Evidence with him to the<lb></lb>
Grand Jury as a Bill of Indictment then Jneferred against the<lb></lb>
Defendant for the said Offence, Which Bill this Deponent who<lb></lb>
afterwards Informed was found a True One, And that the said<lb></lb>
Defendant had Pleaded not Guilty thereto, And this Deponent<lb></lb>
Saith tha he was Informed by the prosecutors Friends and<lb></lb>
Possitively on his Oath Saith that he verily Relieved the said Defendant<lb></lb>
was to be Tryed at the then next Sessions to be holden at Justice Hall<lb></lb>
aforesaid in the Month of December following And that he this Deponent<lb></lb>
Relying on the Truth thereof, and for noctber Cannon reason where ever<lb></lb>
Omitted Attending to Give his Evidence as the Tryal of the said Defendant<lb></lb>
at he next Evening Sessions of the Peace which was held at<lb></lb>
Guildhall as Monday the Ninth day of December when and<lb></lb>
where he this Deponent who Soon afterwards to his Great<lb></lb>
Surprise Informed that the said Defendant had been Called up<lb></lb>
for Trayall and Acquitted for Want of Evidence, And Lastly<lb></lb>
this Deponent Saith that notwithstanding such Omission<lb></lb>
in his Attendance on the said Tryall was in no Sort Wilfully<lb></lb>

Done with a Design to Favour the said Defendant but<lb></lb>
Merely owing to the above Misunderstanding us aforesaid<lb></lb>
Yet this Deponent Saith he Could Give no Evidence touching the above<lb></lb>
Fact against the said Defendant, but only as to his receiving him into<lb></lb>
his Custody upon the prosecutors above Charge of the said Offence and<lb></lb>
Conducting him before Magistrate for the Same as above Setforth</p>
