saith that his Wife being dangerously Ill, he did before he went to the<lb></lb>

, and got there about<lb></lb>
half an hour after two O'Clock in the afternoon of the same Day, when<lb></lb>
to this Deponents great Surprize he heard that the said Defendant<lb></lb>
had been tried, and acquitted for Want of Prosecution, and his<lb></lb>
Recognizance ordered to be Estreated into the Exchequer for not<lb></lb>
Prosecuting her, And this Deponent further saith that he was fully<lb></lb>
determined to prosecute the said <rs type="persName" id="LMOBPS45010_n2390-8">Elizabeth Eyres</rs>

that it was not out of any favour or for Gain or otherwise that made<lb></lb>
him go home, only as before stated, And if this Deponent had thought<lb></lb>
the Tryal of the said <rs type="persName" id="LMOBPS45010_n2390-9">Elizabeth Eyres</rs>

possitively saith that nothing should have hindred him from giving<lb></lb>
Evidence against her, as by his Recognizance he was bound to do, And this<lb></lb>
Deponent humbly hopes that this Honourable Court will for the Sake of his<lb></lb>
Family order his Recognizance to be discharged, And this Deponent <rs type="persName" id="LMOBPS45010_n2390-10">Mary<lb></lb>
