saith that on Sunday the ninth day of March last about nine of the<lb></lb>
Clock at Night as he was going from the Adam and Eso a Publick House as <rs type="placeName" id="LMOBPS45010_geo711">Kensington</rs>

he heard the Voice of a Woman crying Murder on the Road at about one hundred<lb></lb>
Yards distance eat the same time a Man came running by who said there was Murder<lb></lb>
on the Road and that he was going to <rs type="placeName" id="LMOBPS45010_geo712">Kensington</rs>

for a Constable this Deponent thereupon<lb></lb>
alarmed the Publick House and went forwards to see what the Malter and when<lb></lb>
he came up with one <rs type="persName" id="LMOBPS45010_n2002-4">John Yates</rs>

who stood in the Foot way and upon asking him the<lb></lb>
cause of such cry of Murder was answered that was the Man pointing to one <rs type="persName" id="LMOBPS45010_n2002-5">Thomas<lb></lb>
Kingston</rs>

who stood at a little distance who upon asking him the same Question both<lb></lb>
Kingston and Yates fell upon this Deponent and beat him most cruelly And this<lb></lb>
Deponent saith that soon afterwards he indicted said Kingston and Yates in the<lb></lb>
Court of King Bench at <rs type="placeName" id="LMOBPS45010_geo713">Westminster</rs>

which cause is to be tryed as this Deponent is<lb></lb>
informed at the first sittings in next Michaelmas, Term and the other Deponent<lb></lb>
Alexander Oakey saith that he met the other Deponent Faulkener very much cut<lb></lb>
and Wounded and that he with other Assistance had caused the said Kingston and Yates<lb></lb>
to be secured and carried before Justice Fielding where the Prosecutor <rs type="persName" id="LMOBPS45010_n2002-6">William Atkins</rs>

<interp inst="LMOBPS45010_n2002-6" type="surname" value="Atkins"></interp>

appeared<lb></lb>
and was bound in Recognizance to prosecute the said Kingston and Yates for an Assault<lb></lb>
And both these Deponent say that they attended at the same time before Justice<lb></lb>
Fielding and were both Bound in Recognizance to give Evidence for the Prosecuting the<lb></lb>
said Kingston and Yates And these Deponents say that they or either of them did not<lb></lb>
see or hear the said Kingston and Yates Assault or make or use any menaces with<lb></lb>
an intent to commit a Robbery upon the said <rs type="persName" id="LMOBPS45010_n2002-7">William Atkins</rs>

both further say that soon after the above Transaction happened the said <rs type="persName" id="LMOBPS45010_n2002-8">William<lb></lb>
Atkins</rs>

and his Wife who both lived at Brook Green <rs type="placeName" id="LMOBPS45010_geo714">Hammersmith</rs>

have left their<lb></lb>
Habitation and that they can get no Intelligence where they are gone but do verily<lb></lb>
believe they absconded in order to Screen the Prosecution against the said Kingston<lb></lb>
and Yates, And both those Deponent further say that they were intirely Ignnant of<lb></lb>
the Consequence of the Recognizances they entered into on account of the Prosecutors<lb></lb>
absconding these Deponent being only bound to give Evidence against the said<lb></lb>
Kingston and Yates and that both these Deponents were always ready and willing to do<lb></lb>
every thing that Lay in their Power for the Prosecution of the said Kingston and Yates<lb></lb>
& these Deponents apprehended they shod. have had Notice from the said <rs type="persName" id="LMOBPS45010_n2002-9">William<lb></lb>
Atkins</rs>
