maketh oath that on Tuesday<lb></lb>
evening the 8th. instant a dispute arose between some of<lb></lb>
the prisoners respecting their play at Racquets, That the<lb></lb>
deced who was a prisoner came amongst them, & endeavored<lb></lb>
to sindicate the Racquet Master who was party in the<lb></lb>
dispute, on which words arose between the deced and David<lb></lb>
Williams who had just left off playing, in the case of which<lb></lb>
the deced called Williams a Damn'd swindling Scoundrel<lb></lb>
and a Raschal & used other opprobrious language towards<lb></lb>
him and held his fist clinched almost close to William's<lb></lb>
face. That Williams uttered expressions towards the deced<lb></lb>
but what they were this Dept does not particularly recollect<lb></lb>
That then a prisr. of the name of Calvert and the deced had<lb></lb>
words together<gap reason="illegible"></gap>
respecting the playing at Racquets<lb></lb>
during which<gap reason="illegible"></gap>
Williams turned round & asked<lb></lb>
the deced why he trod upon his Toes, and at the same time<lb></lb>
he shoved the deced with his Elbow and afterwards struck<lb></lb>
him with his fist several blows on his face; all of the blows<lb></lb>
were on the deceds face as Dept believes. That the deced did<lb></lb>
not return the blows, but turned aside, and then the matter<lb></lb>
ended. That a short time afterwards Dept was told the deced<lb></lb>
had been taken up stairs very illSays he did not see whether<lb></lb>
the deced trod upon William's Toes or not. Several persons neare<lb></lb>
about them at this time<obscured></obscured>
all standing near together.</p>
